interesting... the guy that was asked to move on "Also I was in the water knee to waist deep NOT NEAR OTHER BEACH USERS"

this just gets more interesting... there has to be more to this....

Which council by law does it infringe on, we have gone from heritage to parks australia laws
If it is a marine park you are not allowed to dig, if its a heritage site you are not allowed to break the ground
If its a national park you are not allowed to remove or touch anything
If its a shipwreck item you cannot posses sell or pick up an item
If its a council park you can be charged with destroying council property if any works need to be done to repair it
Someone please put up the by law and not assumptions

And the people involved should give a full detailed account of what happened so we can make an informed decision

I am and others are also over it...

You need to look at your own councils as they will have similar OR may be not...

I have read and posted the GC By-laws re parks etc... NO ASSUMPTIONS.... The fact that many read and still apply their own assumptions is not my problem!!!!

Here is a couple of links below ( thanks to another DF Member)..

In addition, read the many referenced acts and the dictionaries and all the other Regs that are identified - As they can be the KEY when it comes to understanding the intent and how it relates to the local council. And this lot is just a sample...

Full Audio transcripts and other documentation as to the event can be had; as stated previously, on another forum.

The fact is:

A: You can detect almost any where you want...

But when it comes to recover of items.

B: You will breach many rules and reg's all the time.

Take a cement pill and move when instructed...

And for eg.

Try this one for WA... Not sure if it was passed in 2010, but I am sure some one from WA might have followed up...

Says no digging "big" holes, seems digging a small hole is not an offence. Though they should define the dimensions of a big hole if they plan to fine people for the offence.

I'd just avoid the particular beach in question of where the people were moved on, can't access DF they want you to join to read the forum.

I like the Gathering as being defined as 10 or more... At least the Gold Coast define it as 50 :)

Yeah, makes you wonder how they come up with the numbers. A Mum and Dad with a few friends and kids at the beach would be illegal there........

Might sound crazy, but we dont to get overly vocal, and force them to, raise this at a council meeting......imagine the possible outcome :( better its left a hazy, or murky area :)
